Will Elon Musk ever be forced to testify over his role inside DOGE?

Elon Musk is facing growing legal pressure to answer questions under oath about his role in the controversial “Department of Government Efficiency (DOGE)” initiative, but court rulings and legal protections have so far shielded him from deposition.

Musk, who played a highly influential role in the early phase of the Trump administration’s government restructuring efforts, is now at the centre of multiple lawsuits challenging the legality of actions taken to dismantle federal agencies.

Plaintiffs in one case argue that Musk effectively directed decisions to shut down or restructure government bodies, including the US Agency for International Development (USAID), potentially violating constitutional requirements that significant government authority must be exercised by Senate-confirmed officials.

However, efforts to depose Musk have repeatedly stalled in court. Legal teams attempting to serve him with subpoenas report multiple failed attempts at his properties, including visits in Texas where process servers were allegedly turned away or told he was not present.

Government lawyers have argued that Musk should be protected from deposition under legal precedents that shield senior officials from burdensome questioning that could interfere with government functions. They cite earlier Supreme Court rulings involving high-ranking officials to support their position.

At the same time, the Justice Department has also argued in court that Musk’s departure from government service weakens the plaintiffs’ case, suggesting some claims may now be moot.

Lower courts have at times ruled that Musk should testify or provide evidence, but appeals courts have paused those decisions, citing concerns that plaintiffs have not exhausted other sources of information.

The legal dispute has now become a broader constitutional question: whether Musk can be compelled to explain his role in sweeping government changes carried out during his time linked to DOGE.

As the cases continue, courts remain divided on how far discovery should go — and whether one of the world’s most influential private figures can be compelled to account for actions taken in or around government power.
