James Comey appears in court in case over alleged Instagram post threat
Former FBI Director James Comey made his initial court appearance on Wednesday after surrendering to authorities following a federal indictment related to a controversial Instagram post.
Comey appeared in the Eastern District of Virginia court following his indictment by a federal grand jury on Tuesday on charges involving alleged threats against the president. He did not enter a plea during the hearing.
During the brief appearance, Comey acknowledged the proceedings, responding “Yes, your honor” when addressed by the court. He was accompanied by his legal team and was later released without conditions.
The case centers on a now-deleted Instagram post from last year in which Comey shared a photo of seashells arranged to read “86 47,” captioned as a “cool shell formation.” Prosecutors allege the post could be interpreted as a veiled threat against the 47th president, citing slang interpretations of the number “86” as meaning to remove or eliminate.
The indictment includes two charges: threatening the president and transmitting a threat in interstate commerce. Prosecutors argue that a reasonable viewer could interpret the post as a serious expression of intent to cause harm.
Comey’s legal team is expected to challenge the indictment, including claims of selective and politically motivated prosecution. His attorneys also requested preservation of government communications and public statements that may be relevant to their defense.
The case raises broader legal questions about the boundaries of protected speech and what constitutes a “true threat” under U.S. law. A 2023 Supreme Court ruling requires prosecutors to show that a statement would be perceived as threatening.
The Instagram post in question has also circulated widely in political discourse, with varying interpretations and debate over intent.
This is not the first legal challenge faced by Comey in recent years. A previous indictment on unrelated charges was dismissed in 2024 after procedural issues involving the prosecutor were identified.
Following that dismissal, Comey publicly maintained his innocence and expressed confidence in the independence of the U.S. judicial system. He has reiterated similar statements following the latest indictment.
The case is ongoing, and further court proceedings are expected in the coming weeks.
